JobsOnline Terms of Service for Your Personal Use

Welcome! By using the JobsOnline web site or other JobsOnline services or content (collectively, "JobsOnline Services"), you agree to be bound by these terms and conditions (the "Terms of Service"). The JobsOnline web site, its owner, their respective affiliates, including officers, directors, employees, members, representatives and assigns are collectively referred to herein as “us”, “we” or “JobsOnline”. We reserve the right in our sole discretion to change these Terms of Service at any time. Any changes will take effect immediately. You should read these Terms of Service each time you use this site to ensure that you are familiar with the most current version. If you do not agree to our Terms of Service, you are not authorized to use the JobsOnline Services in any manner or form whatsoever.

Content Linked to by JobsOnline

The employment, job results and other content displayed or linked to by JobsOnline Services are developed by people over whom JobsOnline exercises no control. The search results and other content that appear on the JobsOnline Services are not screened before including them in the JobsOnline Services. A search using JobsOnline Services may produce search results and links to sites that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a JobsOnline Services search will not locate unintended or objectionable content and assume no responsibility for the content included in any search results or otherwise linked to or described by the JobsOnline Services. For purposes of convenience, JobsOnline's Service contains links to third party Web sites. JobsOnline makes no representations or warranties about any third party Web site that you may access through the links. By providing a link to those Web sites, JobsOnline does not endorse, adopt, or otherwise accept any responsibility for the content or use of those Web sites.

Personal Use Only

The JobsOnline Services are made available for your personal, non-commercial use only. You may not use the JobsOnline Services to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. You may not take the results from a JobsOnline Services search or other content from the JobsOnline Services and reformat and display them, or mirror the JobsOnline Services home page or results pages on your Web site. You may not "meta-search" JobsOnline Services. If you want to make commercial use of the JobsOnline Services, you must enter into an agreement with JobsOnline to do so in advance.

No Automated Querying

You may not send automated queries of any sort to JobsOnline Services without express permission in advance from JobsOnline. Note that "sending automated queries" includes, among other things:

·       using any software which sends queries to JobsOnline Services;

·       "meta-searching" JobsOnline Services; and

·       performing "offline" searches on JobsOnline Services.

Privacy Policy

You agree to the JobsOnline privacy policy which is incorporated herein.

Changes In Terms and Conditions and JobsOnline Search Service

We may modify or terminate our services from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time without notice. Please review these Terms of Service from time to time so that you will be apprised of any changes.

Disclaimer of Warranties

THE JOBSONLINE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS AND ALL WARRANTIES, EXPRESS AND IMPLIED, ARE DISCLAIMED TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW (INCLUDING, BUT NOT LIMITED TO, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, JOBSONLINE MAKES NO WARRANTY THAT: (A) THE JOBSONLINE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE JOBSONLINE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (C) YOU WILL QUALIFY FOR THIRD PARTY PRODUCTS FROM OUR THIRD PARTY ADVERTISERS; OR (D) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE JOBSONLINE SERVICES WILL BE ACCURATE OR RELIABLE. THE JOBSONLINE MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. WE WILL NOT BE LIABLE FOR THE AVAILABILITY OF THE UNDERLYING INTERNET CONNECTION ASSOCIATED WITH THE SITE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM JOBSONLINE, ITS THIRD PARTY ADVERTISERS OR OTHERWISE THROUGH THE JOBSONLINE SERVICES, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

YOU UNDERSTAND AND AGREE THAT YOU DOWNLOAD OR OTHERWISE OBTAIN MATERIAL OR DATA THROUGH THE USE OF THE JOBSONLINE SERVICES AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT JOBSONLINE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JOBSONLINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), TO THE FULLEST EXTENT PERMISSIBLE BY LAW FOR: (A) THE USE OR THE INABILITY TO USE THE JOBSONLINE SERVICES; (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION AND/OR SERVICES PURCHASED OR OBTAINED FROM, OR TRANSACTIONS ENTERED INTO THROUGH, USE OF THE JOBSONLINE SERVICES; (C) THE FAILURE TO QUALIFY FOR THIRD PARTY PRODUCTS FROM OUR THIRD PARTY ADVERTISERS; (D) THE UNAUTHORIZED ACCESS TO, OR ALTERATION OF, YOUR E-MAIL ADDRESS; AND (E) ANY OTHER MATTER RELATING TO THE JOBSONLINE SERVICES. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, IN THE AGGREGATE INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS AND ANY AND ALL OTHER TORTS. YOU HEREBY RELEASE JOBSONLINE AND ITS THIRD PARTY ADVERTISERS FROM ANY AND ALL OBLIGATIONS, LIABILITIES AND CLAIMS IN EXCESS OF THE LIMITATIONS STATED HEREIN. IF APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATIONS, THE MAXIMUM LIABILITY OF  JOBSONLINE TO YOU UNDER ANY AND ALL CIRCUMSTANCES WILL BE FIVE HUNDRED DOLLARS ($500.00). THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND JOBSONLINE. THE JOBSONLINE SERVICES WOULD NOT BE PROVIDED TO YOU WITHOUT SUCH LIMITATIONS.

Registration and Password

You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. Personal information and passwords you provide will not necessarily be secured in accordance with industry standards and technology. Since the Internet is not a secure environment, we cannot ensure or warrant the security of any information or password you transmit to the JobsOnline Services. There is no guarantee that information may not be accessed, copied, disclosed, decoded, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Dispute Resolution Provisions

The Terms of Service shall be treated as though it were executed and performed in the State of Delaware and shall be governed by and construed in accordance with the laws of the State of Delaware (without regard to conflict of law principles). Should a dispute arise concerning the terms and conditions of the Agreement or the breach of same by any party hereto, the parties agree to submit their dispute for resolution by arbitration before the American Arbitration Association in Chicago, Illinois, in accordance with the then current Commercial Arbitration Rules of the American Arbitration Association. Any award rendered shall be final and conclusive to the parties and a judgment thereon may be entered in any court of competent jurisdiction. Nothing herein shall be construed to preclude any party from seeking injunctive relief in order to protect its rights pending an outcome in arbitration. To the extent permitted by law, you agree that you will not bring, join or participate in any class action lawsuit as to any claim, dispute or controversy that you may have against JobsOnline (including any owner and other affiliates including employees, officers, directors, members, representatives and assigns). You agree to the entry of injunctive relief to stop such a lawsuit or to remove you as a participant in the suit. You agree to pay the attorney's fees and court costs that JobsOnline incurs in seeking such relief. This provision preventing you from bringing, joining or participating in class action lawsuits: (a) does not constitute a waiver of any of your rights and remedies to pursue a claim individually and not as a class action in binding arbitration as provided above; and (b) is an independent agreement.

Miscellaneous Provisions

Should any part of these Terms of Service be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the JobsOnline Services is in conflict or inconsistent with these Terms of Service, these Terms of Service shall take precedence. Our failure to enforce any provision shall not be deemed a waiver of such provision nor of the right to enforce such provision. The parties do not intend that any agency or partnership relationship be created.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by JobsOnline.
